Can you give guidance on how the ADA and the Pregnancy Fairness Workers Act work with FMLA. what is the standard for undue hardship? Can someone get FMLA for 3 mos, 7 mos PFWA leave, and be out 2 mos under ADA for a year. Are the leaves consecutive? Could an undue hardship be an employer hires two temps to do the employee’s work as an example. Since this is new, will this just be litigated before we have a timeline of when something is an undue hardship. |
